Footpath trading

We have a responsibility to manage activities that have an impact on footpaths by regulating trading activities including the placement of tables and chairs, signs and goods for sale.

What can you do?

Make sure all footpaths are accessible to everyone, including those with limited mobility, parents pushing prams, people using motorised scooters or those with low vision. Safe pedestrian access is the primary purpose of all footpaths. Other activities such as trading, advertising and street events are secondary.

Owners/occupiers of premises who place items on footpaths within Moira Shire require a footpath trading permit. The Community Amenity Local Law  requires all persons to obtain a permit to place anything on a Council footpath. Permits have conditions which ensure an ‘Accessway’ is provided in accordance with the Footpath Trading Guidelines.

All street furniture, infrastructure, signs, trader’s activities and displays must be located towards the kerb side, not along the building or property line. This allows for pedestrians to move safely along the edge of the shop front.

How to apply for a footpath trading permit

To apply for a permit, you must complete a Footpath Trading Application form. As part of your application you must:

• Agree to comply with the Community Amenity Local Law and Footpath Trading Guidelines and any permit conditions by signing the declaration on your application form.

• Provide a certificate of currency in your business name, as part of your Public Liability Insurance policy, with minimum cover of $10,000,000 that covers the footpath trading activity.

Submission of forms and fees can be made in person or by mail as per the application form.
